Javier Sánchez Santos, who claims to be recognized as the son of Spanish singer Julio Iglesias and claims to have a DNA test that certifies him, announced today that he will file a paternity suit on September 4.

His lawyer, Fernando Osuna, explained in a statement that a previous claim was already dismissed in 1999 because of a procedural defect, which is why he admits he may find it difficult to start a new trial.

However, he argues that the reopening of the case can be allowed "through the existence of DNA evidence, which at the time of the first sentence did not exist or were not carried out because of the refusal of the parent."

According to the alleged son of the singer, who is currently 40 years old and resides in the Spanish city of Valencia, a private detective obtained DNA samples from Iglesias in Miami (USA) and, after the appropriate analyzes, it has been concluded that there is Relationship to "99.9%".

"In very specific cases national (Spanish) and European justice have been defending the right of a son to know who his father is, even when there is already a previous sentence that determined non-filiation," said the lawyer.

"It is not permissible for him to be scientifically the son of Julio Iglesias and judicially he is not. Genetically he already has the certainty that he is son of the singer, now he lacks the judicial support," he said.

According to Osuna, the current situation of the complainant is different from that of 20 years ago, because at that time there was no genetic test, since Julio Iglesias objected to it.

Therefore, "reassessment of evidence can not be performed on evidence already in the possession of the court, but could be made on new evidence as is the case today having a matching DNA test."

The lawyer recalled that the Spanish law on matters of filiation, parental authority and economic regime of marriage establishes that firm judgments on filiation "will not prevent the resumption of action based on evidence or facts only provided for by new legislation" .

According to Javier Sánchez, his mother, the Portuguese dancer María Edite Santos, had a relationship with the Spanish singer, fruit of which she became pregnant.

The singer Julio Iglesias, who will be 74 years old, has three children from his first marriage to the Spanish-Filipina Isabel Preysler, and five others with his second wife, the Dutchwoman Miranda Joana Rinjsburguer.
